2. Subject Matter and Scope
These terms of use apply to the use of the iOS app "InventoryFix" (hereinafter "App"). InventoryFix is an application for private inventory management with optional AI-powered object recognition.
2.1 Scope of Functions
- Management of personal items and containers
- Local and cloud-based object recognition
- Search and organization functions
- Premium functions via InventoryFix Pro subscription
3. Cloud AI and Data Processing
The optional Cloud AI function uses Google Gemini for object recognition:
3.1 Google Gemini
We use Google Gemini as the AI model. We strive for high availability and accuracy of recognition, but cannot guarantee the continuous availability of external AI services or the correctness of analysis results.
3.2 Availability
- Cloud AI functions require an active internet connection
- Availability may be affected by factors beyond our control (e.g., server outages, network problems)
- We reserve the right to temporarily deactivate Cloud AI functions (e.g., for maintenance)
By activating Cloud AI, you consent to the transmission of image data to Google services. Details can be found in our Privacy Policy.
4. Usage Restrictions
The following restrictions apply to the use of Cloud AI functions:
- Rate Limiting: Maximum 100 requests per hour per device
- Image Size: Maximum image size: 10 MB
- Abuse: No automated mass requests
- Content: No inappropriate or illegal content
5. InventoryFix Pro Subscription
5.1 Subscription Model
- Provider: Subscriptions are handled through Apple's App Store
- Payment: Charged via your Apple ID account
- Term: Monthly or annually, depending on selected plan
- Renewal: Automatic renewal unless cancelled
5.2 Cancellation
You can cancel your subscription at any time via iOS Settings. Cancellation takes effect at the end of the current billing period. A proportional refund of already paid fees is not provided.
6. Liability and Warranty
6.1 Warranty
We warrant that the App fulfills the advertised basic functions. Statutory warranty rights remain unaffected.
6.2 Liability Limitation
Our liability is limited as follows:
- Unlimited Liability: For intent, gross negligence, personal injury, and under the Product Liability Act
- Limited Liability: For slight negligence only for essential contractual obligations, limited to foreseeable damage
- Excluded Liability: For indirect damages, lost profits, and data losses with proper use
For Cloud AI functions:
- No guarantee for the accuracy of AI results
- No liability for consequences of incorrect AI results
7. Apple App Store Terms
The Apple App Store Terms of Use also apply. In case of conflicts, Apple's terms take precedence.
Important Apple Terms:
- Apple is not a contract partner of these terms of use
- Support and maintenance is provided by us, not by Apple
- For technical problems, please contact us
- Apple's product liability is excluded
8. Termination of Use
8.1 Ordinary Termination
You can terminate use at any time by uninstalling the App. Subscriptions must be cancelled separately in iOS Settings.
8.2 Extraordinary Termination
We may remove your access to the App for serious violations of these terms.
9. Changes to Terms of Use
We reserve the right to change these terms of use for legal changes or feature extensions. You will be informed of significant changes in the App.
10. Applicable Law and Place of Jurisdiction
The law of the Federal Republic of Germany applies to these terms of use, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of Jurisdiction: For disputes, the competent court at the provider's registered office (Lingen, Germany) is responsible. Mandatory statutory provisions on consumer jurisdiction remain unaffected.
11. Online Dispute Resolution

12. Severability Clause
Should individual provisions of these terms of use be or become ineffective or unenforceable, this shall not affect the effectiveness of the remaining provisions. The ineffective provision shall be replaced by an effective one that comes closest to the economic purpose of the ineffective provision.
